Nursing home or group home residents have a care plan that defines whether and when they should be restrained — for the patient’s safety or for safety of the staff and fellow residents. Injuries generally fall into two categories:
- Negligent support — When being transported to a hospital or other facility, patients are often injured because staff fail to properly secure the person or to monitor a person placed in restraints. Resulting injuries include serious falls from a bed or gurney, strangulation, self-inflicted injuries or harm to others.
- Excessive force/improper restraint — Some staff members are abusive or rough in restraining a patient, leading to broken bones, bruising or lacerations. Well-meaning but improperly trained staff may cinch restraints too tight, causing suffocation, unconsciousness, fractures or pressure wounds. Failing to follow procedures can also result in dangerous confrontations requiring staff to forcibly subdue the resident.
In seeking damages, we obtain patient records and care plans, interview staff or witnesses, and examine the training and certification of staff. We research prior reports of abuse or excessive restraint injury, and check into the background of individual staff members for history of violence or terminations by previous employers.
